IslandCue — Terms of Use (End User License Agreement). These Terms govern your use of IslandCue on iOS devices.
1. Acceptance
By downloading or using IslandCue you agree to these Terms. If you do not agree, do not use the app. These Terms are between you and Luis Enrique Lopez, doing business as Zepol AI (“Zepol AI”, “we”, “us”); Apple is not a party to them. Apple's standard Licensed Application End User License Agreement also applies, and where it grants you more, it prevails. Section 13 sets out the terms Apple requires.
2. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use IslandCue on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. You may not sell, rent, sublicense, reverse-engineer or redistribute the app itself.
3. Your Content Is Yours
Every script you write and every video you record with IslandCue belongs entirely to you. You keep all intellectual property rights in them. We claim no license, no ownership and no rights of any kind over your content, and we have no technical means to access it: the app has no servers and no network layer. You are responsible for what you record and for having the rights to any material you read on camera.
4. IslandCue Pro — What Is Free and What Is Paid
IslandCue is free to download. The free version lets you keep the four starter scripts plus three of your own, record takes of up to 15 seconds in 720p with no watermark and save them straight to Photos, and use both Beat Cards and Smooth Scroll reading modes.
IslandCue Pro unlocks Voice-Sync auto-scroll, voice dictation of scripts, unlimited scripts, longer recording lengths (30s, 1m, 3m, 5m), 1080p, 4K 30fps and 4K 60fps capture (where supported by your device's camera hardware and active lens), and Mirror mode for optical teleprompter rigs. Folders are free for everyone. Pro is sold as a Monthly or Yearly subscription or as a one-time “Lifetime” purchase; “Lifetime” means for as long as IslandCue is offered on the App Store (see section 5), not the lifetime of the purchaser.
5. Plans, Prices and Automatic Renewal (Apple Guideline 3.1.2 · California Automatic Renewal Law)
Three plans are offered: Monthly — US$3.99 per month (AUTOMATICALLY RENEWING subscription); Yearly — US$19.99 per year (AUTOMATICALLY RENEWING subscription); and Lifetime — US$29.99 (A SINGLE PAYMENT that does NOT renew).
Prices are shown in your own currency, and may differ by region, on the App Store confirmation sheet before you are charged. That sheet is the authoritative price. For the Monthly and Yearly plans, so there is no ambiguity:
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription RENEWS AUTOMATICALLY for the same period, at the same price, FOR AS LONG AS YOU DO NOT CANCEL.
- Renewal is prevented only if you turn off auto-renew AT LEAST 24 HOURS BEFORE the end of the current period.
- Your account is charged for the renewal within the 24 hours before the current period ends.
- HOW TO CANCEL, AT ANY TIME: open iOS Settings → tap your name (Apple Account) → Subscriptions → IslandCue → Cancel Subscription. You can also reach the same screen from the App Store app by tapping your profile picture, then Subscriptions.
- Canceling stops future renewals; it does not shorten or refund the period you have already paid for, and you keep Pro until that period ends.
- Deleting the app does NOT cancel a subscription. Cancel it on the Subscriptions screen above.
- We do not offer free trials or introductory offers in this version. If a future version does, its length, its price afterwards and how to cancel before being charged will be stated here and on the purchase screen before you confirm.
The Lifetime plan is a one-time purchase. It does not renew, there is no recurring charge, and nothing further is ever billed. “Lifetime” refers to the lifetime of the app: Pro stays unlocked for as long as IslandCue is offered on the App Store and on the devices and iOS versions it supports, not for the lifetime of the purchaser.
6. Restoring and Refunds
Tap “Restore Purchases” on the IslandCue Pro screen to restore an earlier purchase on a new device or after reinstalling. All purchases, billing and refunds are handled by Apple, not by us; we cannot issue refunds. Refund requests go to Apple Support (reportaproblem.apple.com).
7. Children and Family Purchases
IslandCue creates no accounts and collects no personal data from anyone, including children under 13. Purchases on a device used by a child remain subject to Apple's parental controls — Ask to Buy, Family Sharing and Screen Time — which are configured in iOS Settings and enforced by Apple before any charge is made.
8. Acceptable Use
Do not use IslandCue to record or distribute material that is unlawful, that infringes someone else's rights, or that was captured without the consent required where you are. Do not attempt to bypass the Pro gates, tamper with purchase verification, or use the app in a way that interferes with another person's device.
Recording other people. Some laws, including California's, require the consent of every party to a confidential conversation before it is recorded. If you record anyone other than yourself with IslandCue, you are responsible for obtaining the consent the law where you are requires, and for complying with the rules of the place where you record.
9. No Warranty
IslandCue is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that recording, speech recognition or saving to Photos will be uninterrupted or error-free on every device, in every language, or under every condition. Voice-Sync depends on Apple's on-device speech models and on your pronunciation, pace and surroundings. Available video resolutions and frame rates (including 4K 30fps and 4K 60fps) depend on the physical camera sensor and active lens of your specific device model.
10. Limitation of Liability
To the maximum extent permitted by law, Luis Enrique Lopez, doing business as Zepol AI, is not liable for any indirect, incidental, special, consequential or punitive damages, or for any lost recording, lost script, lost time or lost opportunity arising from your use of IslandCue. Our total liability for any claim relating to the app is limited to the amount you actually paid for it in the twelve months before the claim. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. IslandCue is a reading and recording tool: keep your own copy of anything you cannot afford to lose.
11. Changes and Termination
We may update these Terms in a future version of the app; the updated text will appear here with a new “last updated” date, and continuing to use the app means you accept it. Any change to a price or to a renewal term of a subscription you already hold will be handled by Apple, which will ask for your consent before the new price applies. This license ends if you stop complying with these Terms, and you may end it at any time by deleting the app.
12. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, except where the law of your own country or state of residence must apply — including the California Automatic Renewal Law for residents of California.
13. Apple
Apple requires the following terms, which apply to your use of IslandCue on any Apple device:
- These Terms are between you and us only, not with Apple. Apple is not responsible for IslandCue or its content.
- Your license is limited to a non-transferable license to use IslandCue on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
- We, not Apple, are solely responsible for providing any maintenance and support for IslandCue. Apple has no obligation to furnish any maintenance or support services for the app.
- If IslandCue fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to IslandCue, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims by you or any third party relating to IslandCue or your possession or use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation.
- In the event of any third-party claim that IslandCue or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
- You represent and warrant that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using IslandCue — for example, your wireless carrier's terms of service.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of them Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
